I forbid selling my work to other people.

It is forbidden to resell VTuber models without notifying me and discussing further nuances.

First, you will provide me with information about the order via the order form. Please make sure you include image references.

I will draw you a sketch and send a screenshot of it to you. If you approve it, the payment will be sent to you. Once the payment is confirmed, I will proceed with the drawing.

Once the sketch is approved, you will be charged for extra revision. Color adjustments are still free.

Updates regarding major changes will be provided at weekly intervals (perhaps daily) via Discord - unless I say otherwise - from the beginning to the end of the project. Further improvements will be made in accordance with customer suggestions.

Workflow may be adapted depending on the complexity or urgency of an order and will be discussed with the client prior to engaging/retaking the commission.

The commission is considered done once the final work has been delivered and the client has given approval or if the client has not replied within 48 hours from delivery.

In the case a client wants to cancel an on-going commission, they may do so. However, WIPs are only given if the client has not issued a refund and I'm close to the halfway process mark.

I will NOT offer any WIPs if the work is partially completed or near completion.

Payments will be made exclusively through PayPal. Two invoices will be sent, one at the start of the project (50%) and one at the end (50%). The value of the commission will be split in half and any additional costs added due to eventual production changes will be charged at the end.

Work will be delivered only when the last invoice payment has been issued.

If by any means the client no longer wishes to continue working with me, the initial payment will not be refunded. PayPal chargebacks will also be denied after the work has been finished or delivered.

Refunds are NOT GIVEN when:

The work has been delivered;

The client no longer wishes to work with me throughout the process of working on the order. In this case, the initial payment (corresponding to 50% of the commission) will not be refunded;

Two weeks has passed since the commissioned was delivered;

The client has been sent updates and access to the work's progress but did not comment or when they claim to not have seen said progress;

The client has untruthfully expressed satisfaction;

The client has intentionally upheld negative feedback and suggestions regarding corrections throughout the commission process.

Refunds WILL BE GIVEN when:

The order has been delayed for more than double the estimated delivery time given and the work has not seen any progress. In this case, I will contact the client as soon as possible and state the reason. If the client refuses to give me a deadline extension, I shall be issuing a refund;

The client has paid in full and has requested a refund before I could work on the commission;

I cannot fulfill the commission by the given deadline.

Note that refunds will be given with deductions from PayPal transaction fees.

VTuber Art, commissions fall under the Special Commercial Usage License, therefore all fees are included in the final cost of a commission.

When you use my work, you are required to indicate my authorship on all platforms you used to publish the work

Unless stated otherwise, all the prices indicated do not include commercial usage of the work. Please discuss with me if you would like to purchase a commercial license for the work.

The client may use this model for commercial purposes such as streaming and social media graphics;

I do not work without the application of commercial usage fees in my artwork.

The client is not allowed to modify the model. This include editing out parts of the model, modifying it, and/or reusing it for personal and commercial purposes.

You are not allowed to resell my work as your own or use it for merchandise. An additional fee will be charged in order for this right to be granted.

By accepting the Terms of Service, you are obligated to credit me as the artist under your socials bio.

My portfolio and promotion of commissions.

This means I can use any of my works to promote myself after said works have been delivered. An extra fee will be charged for a Non-Disclosure Agreement (NDA) depending on the type of work it is;

Modify and resale the model.*;

Reuse common textures and assets for other models, such as background effects, glasses, acessories, etc.

I am NOT allowed to modify and resell an already completed model commission.

*Applicable only in the event of:

A client does not wish to use the model anymore during and right after the commission process;

Has filed a chargeback;

The client has decided to not carry on with the commission in its developement.

I prefer to focus on artwork, so I don't have a waiting list (but I can indicate roughly when I'll be available for the next Commission)

RIGHTS & USAGE

The commissioned piece may NOT be used for commercial purposes and cannot be redistributed or reproduced.

The client may NOT make any profit off of the piece, which includes but is not limited to digital prints, physical items, etc.

The artist retains all rights to the piece of artwork itself, including the right to make any merchandise.

Removing artist’s watermarks is not allowed.

The artist retains the right to crop, edit, or alter the image for promotional use.

The artist does not claim any rights to any intellectual property of the commissioner or the character(s).

The commissioned artwork may not be resold.

The client has a right to print a copy of the commissioned artwork for personal use. It may not be redistributed or sold in any way.

CREDITING

You may not remove my signature from the original image file.

You are permitted to crop out the signature for things like a profile picture, but it must not be removed otherwise.

You will make sure to credit my work if you intend to upload it yourself.

You will not claim my work as your own.

You will not copy, trace, resell, or redistribute my work in any form under normal circumstances.

COURTESY

I have the right to refuse any commission work I do not want to do.

I am not obligated to redo commissions for free, should my artistic ability improve.

FINAL PRODUCT

There may be slight differences between the samples in my gallery and the illustration you will receive.

You, the Client, are responsible for saving any information, images, and other digital data I provide.

Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure, accidental deletion, or loss.

NDA (Non-disclosure agreement)

I reserve the right to record and Livestream the progress of commissions.

I reserve the right to upload your completed commission to my networks with appropriate crediting.

ABOUT PROCESS:

I will start to draw only when I'll get the payment. Please, notify me when you send the payment.

After your payment is received I'll send you WIP for approval. Any changes can be applied.

After the sketch is approved, I'll only fix my own mistakes

You can ask me to adjust or change when sketch and line cleaning are still in process.

ㄴAlso, you can ask it only 2 times. so please be careful when you check the WIP.

I try to work quickly, but sometimes I need more time, so be patient, please.

At the end you'll get a link where you can download art in high quality.

If the customer fails to keep in contact for a long time, the commission will be dropped, without any refund.

The whole process is done via e-mail or you can apply for a friend through a discord. You can send a 1:1 message.

Generally to complete the commission depending on how complex your request/character(s) are.

The expected turnaround time is a minimum of 1-2 months. I will be working at my own pace. Please don't rush me.
